Contrary to what most citizens have been led to believe, there is no law requiring 99% of Americans to file or pay a federal income tax (FIT). Neither your CPA, your tax attorney, your elected representatives, nor even the IRS itself can point to a statute that mandates this obligation for the average working American — because it simply does not exist and never has.
You Were Never Required to File — Until You Volunteered
If you were born or naturalized in one of the 50 states of the Union — or had at least one parent who was — then you were never under any legal obligation to file or pay a federal income tax. However, the moment you filed a Form 1040 for the first time, you unknowingly made a legal “election” to be treated as a statutory taxpayer.
Before that point, the IRS had no jurisdiction over you. In fact, you could have earned a billion dollars over a 100-year lifespan and never heard from the IRS once — because had you never elected to be a taxpayer by filing a 1040, you would have continued to be protected by Article 1, Section 9, Clause 4 of the Constitution, which shields Americans from direct taxes like the federal income tax.
But by filing, you voluntarily waived your constitutional protections, and stepped into the IRS’s legal framework, and with that election came new obligations: the legal requirement to file and pay federal income taxes every year. Not because you were ever originally required — but because you unknowingly agreed to be.
